On order of the Court, the application for leave to appeal and application for leave to appeal as cross-appellant are considered, and, pursuant to MCR 7.320(F)(1), in lieu of granting leave to appeal, we AFFIRM the result reached by the Court of Appeals with regard to the question of attorney fees but not the rationale it employed to reach that result. We affirm the result reached by the Court of Appeals because this case was not decided pursuant to the Michigan Environmental Protection Act.
